An exception applies in cases where it is not possible to obtain prior consent for factual reasons and the processing of the data is permitted by statutory provisions.
2. Legal basis for processing personal data
If we obtain the data subject’s consent for the processing of personal data, Art. 6(1)(a) of the EU General Data Protection Regulation (GDPR) applies as the legal basis for the processing of personal data.

The legal basis for the temporary storage of data and log files is Art. 6(1)(f) of the General Data Protection Regulation (GDPR).
3. Purpose of data processing
The temporary storage of the IP address by the system is necessary to enable delivery of the website to the user’s computer. In Germany, the statistical pay gap between genders is around 18 percent. Even with the same formal qualifications and work characteristics, this gap is still six percent. According to the Federal Ministry of the Family, this is a clear indication of hidden discrimination against women on the labour market. (see BMFSFJ)
The “Gesetz zur Förderung der Transparenz von Vergütungsstrukturen” (Act to promote transparency of remuneration structures) (EntgTranspG) is intended to enforce the requirement of equal pay for women and men for equal or equivalent work in addition to the General Equal Treatment Act, thus combating direct and indirect discrimination on the basis of gender. For the implementation of this objective at company level, the law provides, among other things, for the publication of a report on equality and equal pay as an appendix to the management report. This publication is intended to fulfil this reporting obligation.
Commerz Real AG ("Commerz Real") is a company of the Commerzbank Group. On the one hand, the company initiates its own measures to promote equality and to achieve equal pay for women and men. On the other hand, Commerz Real participates in many ways in the measures that Commerzbank AG ("Commerzbank") takes to promote equality and equal remuneration.
Commerz Real is a company that is not bound by or does not apply collective agreements and will submit the report pursuant to Section 22 para. 2 EntgTranspG every three years.
